      2. Application of these Terms and Conditions

        1. These terms and conditions of sale (together with our Terms of Use, our Privacy Notice and Cookies Policy apply to all orders you place and any purchases you make on this website (regardless of how you accessed it) or via telephone or e-mail where you are purchasing as a consumer (i.e. for private consumption and not for resale or as part of a business activity).  

        2. Please read these terms and conditions carefully and make sure that you understand them before placing your order.  They do not affect your legal rights. 

        3. You will be required to confirm during the ordering process that you have read these terms and conditions and agree to be bound by them.

        4. We may change these terms and conditions at any time.  Any changes will take effect on the date they are posted onto the site (see date above).  

      3. Age restriction

        1. It is an offence in the UK to sell alcohol to any person under the age of 18 both online and in store. Therefore we will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18. By placing an order you confirm that you are at least 18 years old and we reserve the right not to deliver if we are unsure of this.  

        2. Please note that Majestic operates an age verification policy which applies at all delivery and collection points and you may be asked to provide ID both on collection and at delivery.

      4. Our products

        1. The images of the products on our website are illustrative only. Although we have made every effort to display the colours accurately, we cannot guarantee a device’s display of the colours accurately reflects the true colour of the products. Your products may vary slightly from those images. 

        2. Due to the nature of our products, we cannot guarantee that the vintage shown on the product page will be the same as the product you receive. If you are unhappy with the product you receive then you may exchange the product or return the product to us for a refund under the returns and cancellations section below.

        3. All product measurements are approximate only and the packaging of the products may vary from that shown in images on our website. 

        4. You should always read the labels, warnings and instructions provided on or with the products before using them and not rely solely on the information on our website. This notice does not affect your legal rights.

      5. How to order 

        1. You can order our products online via this website, by calling or emailing your local Majestic store or by calling our Customer Services Team and making payment in accordance with these terms and conditions. 

        2. You can find detailed step-by-step instructions on how to place an order for products on our website by visiting our Frequently Asked Questions page. 

        3. You can access your shopping basket, review it and make changes to it at any time up until the point at which you place your order. Please take the time to check your order before submitting it. If you submit an order in error, you will have the opportunity to cancel it (see below).

        4. If you place your order on a Saturday, Sunday or bank holiday, the order will be processed and confirmed, usually, on the following business day in the UK. 

        5. Your order will only be accepted by us once we process your payment, at which time we will email you confirming your order. It is at this point that the contract between you and us for the sale and purchase of the products ordered by you will be formed and become binding. The contract that is formed shall be in English and will include these terms and conditions.

        6. We reserve the right not to accept any order.

        7. All products are offered subject to availability. We cannot guarantee the availability of specific vintages.

      6. Products

        1. We cannot guarantee the availability or otherwise of any product at any store.

        2. If a product is unavailable after an order is placed, and you have not opted for substitutions at the point of ordering, then we will contact you to either arrange a replacement, or agree a refund or alternative arrangement.

      7. Substitutions

        1. If you opt for substitutions when ordering, this means that if a product within an order is unavailable, we shall replace it with a similar product of equal or higher value of our choice. For more details on substitutions, please see our Frequently Asked Questions page.

      8. Delivery

        1. Your order will be delivered to the delivery address notified by you at the time of placing your order. We are not liable whatsoever for any products delivered to an address which has not been correctly provided by you. You may receive communications from our courier during the delivery process.

        2. Please note delivery to a neighbour or nominated safe place location may not be available for age restricted items. Upon home delivery or collection from a drop off point, the recipient must provide proof they are the stated person on the delivery documentation. Attempted delivery can occur up to 3 times, after which the products will be returned to Majestic where we then ask you to contact us. The following photo identification is accepted: a passport and/or a UK or European Union photocard driving licence.

        3. If, after a failed delivery, you do not re-arrange delivery or collect the products from the location notified to you, we will contact you for further instructions and may charge you for any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and we will refund you the money you have already paid for the order, and we are entitled to deduct from the refund a reasonable sum to cover our costs incurred as a result.

        4. We are responsible for the products until the point they are delivered to you. You are responsible for the products on delivery.

        5. We offer standard delivery and nominated day delivery services, any charges for which will be displayed during the order process. For nominated day delivery, if our courier is unable to deliver to the address you have provided to us in your order they will either leave your delivery in a safe place or leave instructions for you to re-book delivery.         6. We do not deliver to the Channel Islands or destinations outside the UK. We are unable to ship to PO Box addresses.

      9. Click & Collect

        1. We may from time to time offer a click and collect service for orders placed on the phone, website or via e-mail to certain selected stores.

      10. Prices

        1. All prices are as shown on our website and are inclusive of UK VAT. Our prices exclude delivery charges and you will be informed at check out about the delivery options and charges for your order (see above under Delivery).  

        2. Promotional offers and prices are as stated, with no further discounts available unless we indicate otherwise.

        3. Although we try to ensure that all pricing, case and unit size information on this website is accurate, occasionally an error may occur and products may be mis-priced. If we discover a pricing, case or unit error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or cancel your order and notify you. We are not obliged to supply products at the incorrect price, case or unit size.

        4. We reserve the right to adjust prices, offers, products and their specifications products at our discretion at any time before (but not after) we accept your order. We reserve the right to change prices at any time.

        5. We accept payment by PayPal, American Express, Mastercard and Visa.  Payment is deducted when we despatch your order to you.  

      11. Price match

        1. We never want you to feel you’ve paid too much when you shop at Majestic. If you find a wine of the same product (including type, vintage, quality and quantity) cheaper at these retailers - Waitrose, Sainsbury's, Tesco, Morrisons, Asda and the Coop, we’ll match that price for a quantity of up to 6 bottles in any one transaction. The price match price does not include promotion prices, loyalty membership prices or any other offer or conditional pricing (eg Clubcard, Nectar)

        2. Alternatively, we’re confident we can find you a better tasting wine for the same price. Plus, if it’s not absolutely delicious we’ll give you your money back under the Majestic 'No Quibble' guarantee (for more details on this, including eligibility, click here).

        3. Just mention the wine you want to match to one of our colleagues in store, along with proof of the retailer offering the wine for a cheaper price, or give our Customer Contact Centre a call on 0345 605 6767.

        4. The offer is subject to availability. Prices are matched pro-rata by unit-price per item.

        5. We’re sorry that we’re unable to offer the Majestic Price Match in Scotland due to the Alcohol Scotland Act 2010 and Wales due to the Public Health (Minimum Price for Alcohol) (Wales) Act 2018.

        6. We reserve the right to amend or remove individual products and retailers from the price match policy or remove or amend the price match offer at any time

      12. Returns and cancellations 

        1. We will provide a full refund or replacement for any wines that are faulty. This does not affect your statutory rights.

        2. We may require faulty bottles to be returned to us. We will arrange this as necessary at your convenience and at our cost.

        3. In addition, you may cancel your order at any time until 14 working days after delivery. Should you decide to cancel, the products should be returned to us as new and in a saleable condition to your nearest store or by post or courier.  

        4. You can cancel your order during this period by e-mailing us at info@majestic.co.uk, calling us on 0345 605 6767 or writing to us at Majestic House, The Belfry, Colonial Way, Watford, Herts, WD24 4WH. 

        5. Your cancellation is effective from the date you notify us and you must return the cancelled products to us within 14 days of informing us that you wish to cancel.

        6. If you cancel your order in accordance with these term and conditions we will refund to you the full price of the products that you paid including delivery charges except:

          1. we are only obliged to refund delivery costs for the least expensive delivery method we offer. Therefore if you chose a more expensive form of delivery when ordering (e.g. nominated day delivery) we will not pay the difference between this method of delivery and our least expensive method of delivery; and

          2. we may reduce your refund (excluding delivery costs) to reflect any deduction in the value of the products if this has been caused by your use or handling of the products which would not be permitted in a shop. You have a legal obligation to take reasonable care of the products while they are in your possession and are responsible for the risk of damage during transport. 

        7. All refunds to you will be made by the payment method you used when paying for the order being refunded.  If a gift voucher was used for purchase, a refund will take the form of a credit note.

        8. We will process the refund as soon as possible. If you return the products to your local store this will usually be done at the point of return (if within business hours). Otherwise, all refunds will be made no later than 14 days after we have received the products from you, or if earlier, 14 days following the day you provide us with evidence the products have been sent.

        9. If you are returning your products by post, we recommend that products are sent by registered post with your local post office or by courier so that you can track the products and that you always retain evidence of posting or proof of shipment and the tracking number until the purchase price has been refunded.  

        10. As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau. Nothing in these terms and conditions will affect these legal rights.

      13. Complaints

        1. In the event of complaint please contact the store concerned if it refers to a particular order. Alternatively email info@majestic.co.uk giving as much detail as you can. All complaints will be acknowledged within 48 working hours and we will do our best to resolve your complaint within a further 72 working hours. You will be kept informed if there is any delay beyond this. Each complaint will be treated as confidential.

      14. Correspondence

        1. If you have any queries about your order, in the first instance please contact your local store, or our customer contact centre by using the contact information provided here, or as indicated on your order confirmation email and on the website.

      15. Our Responsibility for Loss or Damage

        1. We do not exclude or restrict our liability for death or personal injury resulting from our negligence or that of our agents or for fraud or fraudulent misrepresentation or for any breach of any terms implied by law or any matter that we are not permitted to limit or restrict by law.  

        2. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms and conditions or our failing to use reasonable care and skill, but we are not responsible for any:

          1. loss or damage that is not foreseeable (loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process);

          2. loss or damage which is not caused by our breach of these terms and conditions; or

          3. business losses and/or losses to non-consumers.

        3. Each provision of this section operates separately.  If any part is disallowed or found to be ineffective by any court or other competent body the other parts will continue to apply.

      16. General

        1. These terms and conditions and all transactions relating to this website and/or phone and e-mail orders shall be governed by and construed in accordance with the laws of England & Wales and any disputes will be subject to the non-exclusive jurisdiction of the English courts unless you live in Scotland in which case the relevant law will apply, and you can choose to take action against us in your local courts. 

        2. We do not accept amendments to these terms and conditions/any variations to these terms and conditions must be signed by an authorised signatory of our company.

        3. You may not transfer any of your rights or obligations under these terms and conditions to another person without our prior written consent. We can transfer all or any part of these terms and conditions to another organisation but your rights under these terms and conditions will not be affected.

        4. If these terms and conditions are terminated by either of us for any reason, neither of us will lose any rights which have already accrued.

        5. If, at any time, we do not require you to comply with any part of these terms and conditions, this will not prevent us from doing so in the future.

        6. If any part of these terms and conditions is disallowed or held to be ineffective by any court or other competent body, the rest of the terms and conditions will not be affected.

      17. Voucher usage

        1. Voucher offers have no cash value, are not for sale, and are only valid at participating Majestic Wine stores. Unless specified, the voucher or online code is not valid at any Majestic Wine stores in Scotland and Wales. Strictly over 18’s only. Photocopies are not accepted, and vouchers may be retained by store staff at the point of purchase.

        2. The expiry date is as specified on the voucher or, where no such date is specified, the voucher shall expire at 23:59 on the date of issue. In the case of a product which is the subject of a voucher being out of stock within the promotion period, Majestic may be able to offer a replacement product at the store manager's discretion. Majestic staff reserve the right to refuse a voucher being claimed should they feel the transaction is in breach of terms and conditions.

        3. We reserve the right to withdraw or cancel vouchers at any point.

        4. Ask in store or call our Customer Contact Centre on 0345 605 6767 for further details.

      18. Gift Cards 

        1. Valid gift cards can be used to purchase all products in Majestic UK stores, but cannot be used for glass loan deposits. 

        2. Gift cards are valid for two years from the date of issue. Unused gift cards after this time cannot be used or refunded.

        3. Gift cards cannot be redeemed or exchanged for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender.

        4. If your purchase exceeds the value of the gift card, balance must be paid by cash, debit or credit card.

        5. If your purchase value is less than the face value of the gift card redeemed, no change can be given.

        6. If you return any products you have purchased using a gift card, the refund balance will be returned to you in the form of a gift card.

        7. Gift cards cannot be replaced if lost or stolen.

        8. Majestic reserves the right to cancel a gift card if we deem necessary. If so, we will provide a replacement gift card of equivalent value unless we suspect fraud in relation to the original gift card.

        9. Majestic reserves the right to vary or replace these conditions at any time.

      19. Promotional offers, subscriptions and memberships

        1. We may from time to time run promotions or special offers on our products and/or various subscriptions or memberships for our products. Where you order products which are included in a promotion or special offer or become a member or subscribe to a service, there are additional terms and conditions which apply to those promotions, special offers, subscriptions and memberships which can be found here. We reserve the right to withdraw these promotions, special offers, subscriptions and memberships at any point.

      20. Majestic in Scotland

        1. Our prices in Scotland work differently than England and Wales

        2. The Alcohol Scotland Act 2010 disallows any alcohol promotion offering customers a discount for buying multiple products in Scottish stores whilst the Alcohol (Minimum Pricing) (Scotland) Act 2012 sets a minimum price per unit for all alcoholic beverages sold in Scotland.

        3. So that all our customers can benefit from the same competitive pricing, wherever a Mix Any Six & Save price is offered in England and Wales, this will be the single bottle price we charge in Scotland, unless such a price is beneath the minimum price threshold as outlined by the Alcohol (Minimum Pricing) (Scotland) Act 2012, in such cases the price will automatically be changed to reflect the minimum legal price in Scotland.

      21. Online pricing

        1. Our website allows you to indicate where you would like delivery or collection before ordering. By default, our website shows the pricing in England and Wales. If you select an address served by a store in Scotland, however, the prices shown online change to reflect the single bottle prices effective in Scotland as per the Alcohol (Minimum Pricing) (Scotland) Act 2012.

        2. In the vast majority of cases, the total for your order will be exactly the same as an order placed in England or Wales however prices may vary due to differences in the way the prices are rounded when English multi-buy discounts are calculated.

        3. Since Scottish Licensing Legislation only covers deliveries that originate in Scotland, some deliveries to Scottish addresses are not affected because they originate in England. In these cases the prices shown online will be the prices valid in England and Wales including Mix Any Six & Save discounts. This is also the case if you are based in Scotland but are placing an order for delivery to an address in England or Wales.

      22. How we use your personal information

        2. Any changes to email contact preferences usually take between 2-7 days to take effect, but in some instances may take as long as 28 days to take effect. 

      23. Glass, Chiller and Ice bucket hire

        1. These terms and conditions set out terms on which you hire glass, chiller and ice buckets (Equipment) from Majestic. On hire of the Equipment you agree to these terms and conditions.

        2. All Equipment hired remains the property of Majestic at all times.

        3. You will be required to collect the Equipment in-store.

        4. We will ask you to confirm the date of your event (which we shall record on our system for the purposes of section 4(a)), and to pay a deposit on demand and in-store, when collecting the Equipment for use, as security on the Equipment hired. The deposit will be refunded to you on the original source of the funds when you return the Equipment, provided that:

          1. you return all the Equipment within two weeks of the date of your function; and
          2. the Equipment is returned, washed and clean, and in the same condition and state in which you collected it for hire.
        5. You accept full responsibility for the security and safe use of the equipment until returned to us in-store. Please note that you may return the Equipment to any of our stores. If you return the Equipment in a poor or damaged condition, you may lose your deposit or your deposit may be reduced by an amount proportional to the damage caused, subject to the state of disrepair and our reasonable discretion.

        6. Whilst we will make every endeavour to supply the Equipment, all items of Equipment are offered subject to availability in-store

      24. In Store Tasting
        • Book in advance at your local Majestic store if tasting for a specific event (including a wedding or large party). Equipment is provided in store for the purposes of tasting, subject to availability.

        • The range of beverage products available for tasting will be subject to the store’s absolute discretion or as advised by the product supplier.

        • The quantity and volumes for tasting will be subject to the store’s absolute discretion. Majestic will not tolerate, and shall take all steps to prevent, any excessive consumption of alcohol on its premises.
        • All individuals participating in tasting must be 18 or over (being the legal drinking age in the UK).
        • Dates, times and product availability may vary and tasting events may need to be changed at the discretion of Majestic sometimes at short notice, please contact your local store for details. Selected stores only.

      4. We’re sorry that we’re unable to offer the Majestic Price Match in Scotland due to the Alcohol Scotland Act 2010 and Wales due to the Public Health (Minimum Price for Alcohol) (Wales) Act 2018.

    12. Quality 

      1. If any wines do not conform to any applicable statutory or other warranties or other terms, we will, at our option, replace the wine or make, so far as is fair, a refund of all or a part of the price. If we comply with this obligation, we shall have no further liability in respect of, or arising from, such non-conformity.

      2. We may require faulty bottles to be returned to us. We will arrange this as necessary at your convenience and at our cost.

    13. Complaints

      1. In the event of complaint please contact the store concerned if it refers to a particular order. Alternatively email info@majestic.co.uk giving as much detail as you can. All complaints will be acknowledged within 48 working hours and we will do our best to resolve your complaint within a further 72 working hours. You will be kept informed if there is any delay beyond this. Each complaint will be treated as confidential.

    14. Correspondence

      1. If you have any queries about your order, in the first instance please contact your local store, or our customer contact centre by using the contact information provided here, as indicated on your order confirmation email and on the website.

    15. Our Responsibility for Loss or Damage

      1. Subject to section 15.5 below, our total aggregate liability however arising in respect of all claims (and series of related claims) arising in relation to your order, shall be limited to a sum equal to the price paid by you for the products or services under that order.

      2. Notwithstanding any other provision in these terms, but subject to section 15.5 below, we shall have no liability however arising out of or in connection with these terms and/or the supply of the products or services for any:

        1. direct or indirect loss of or damage to:

    1. profit;

    2. revenue; 

    3. business;

    4. contract;

    5. opportunities;

    6. anticipated savings; 

    7. data;

    8. goodwill;

    9. reputation;

    10. use; 

    1. indirect or consequential loss or damage; or 

    2. claim arising out of a claim against you by a third party;

    1. The parties agree that each of the sub-clauses in section 15.2 and each of the sub-paragraphs 15.2.1 a)-j) constitute separate terms and the introductory wording of section 15.2 shall be applied to each of them separately.  If there is any claim or finding that any such individual sub-clause or sub-paragraph is unenforceable for any reason, such unenforceability shall not affect any other provision within section 15.2 or otherwise.

    2. The term “however arising” when used or referred to in this section covers all causes and actions giving rise to the liability of us arising out of or in connection with these terms and/or the products/services including (i) whether arising by reason of any misrepresentation (whether made prior to and/or in these terms) negligence, breach of statutory duty, other tort, repudiation, renunciation or other breach of contract, restitution or otherwise; (ii) whether arising under any indemnity; or (iii) whether caused by any total or partial failure or delay in supply of us or defective products/services. 

    3. Our liability shall not be limited or excluded by any provision of these terms to the extent prohibited or limited by law and in particular nothing in these terms shall exclude or limit liability:

      1. for death or personal injury caused by negligence to the extent prohibited by law;

      2. for fraudulent misrepresentation or other fraud.

    4. Except as expressly set out in these terms all warranties, conditions, terms and liabilities express or implied, statutory or otherwise, on our part, in respect of compliance with descriptions, quality or fitness for purpose are excluded except to the extent such exclusion is prohibited or limited by law. 

                1. General

                  1. We shall have the right to suspend delivery and/or cancel or reduce the volume of the products or services to be supplied and shall not be liable in any way for loss, damage or expense arising directly or indirectly from this, or any other failure or delay in our performance of the order, to the extent that this has been caused by any circumstance beyond our reasonable control, including industrial disputes (whether or not involving employees of the Seller),epidemics, pandemics, civil emergencies or failure or delays by our suppliers.

                  2. You acknowledge that you do not rely on, and shall have no remedy in respect of, any representation, whether negligent or not, of any person which is not expressly set out in these terms and conditions, and you shall not have any claim for innocent or negligent misrepresentation or negligent misstatement based on any statement, representation, warranty or other term which is expressly set out in these terms and conditions.

                  3. These terms and conditions and all transactions relating to this website and/or phone and e-mail orders shall be governed by and construed in accordance with the laws of England & Wales and any disputes will be subject to the non-exclusive jurisdiction of the English courts. 

                  4. We do not accept amendments to these terms and conditions/any variations to these terms and conditions must be signed by an authorised signatory of our company.

                  5. You may not transfer any of your rights or obligations under these terms and conditions to another person without our prior written consent. We can transfer all or any part of these terms and conditions to another organisation but your rights under these terms and conditions will not be affected.

                  6. If these terms and conditions are terminated by either of us for any reason, neither of us will lose any rights which have already accrued.

                  7. If, at any time, we do not require you to comply with any part of these terms and conditions, this will not prevent us from doing so in the future.

                  8. If any part of these terms and conditions is disallowed or held to be ineffective by any court or other competent body, the rest of the terms and conditions will not be affected.

                2. Voucher usage

                  1. Voucher offers have no cash value, are not for sale, and are only valid at participating Majestic Wine stores. Unless specified, the voucher or online code is not valid at any Majestic Wine stores in Scotland and Wales. Strictly over 18’s only. Vouchers can be used once only (unless indicated otherwise on any voucher-specific terms and conditions) and only one voucher is redeemable per transaction and per household, they cannot be used in conjunction with any other offer. Photocopies are not accepted, and vouchers may be retained by store colleagues at the point of purchase.

                  2. Some of our vouchers offer a free bottle. Such offers are also subject to these standard terms & conditions and will state the value of the free bottle to be claimed.

                  3. The expiry date is as specified on the voucher or, where no such date is specified, the voucher shall expire at 23:59 on the date of issue. In the case of a product which is the subject of a voucher being out of stock within the promotion period, Majestic may be able to offer a replacement product at the store manager's discretion. Majestic colleagues reserve the right to refuse a voucher being claimed should they feel the transaction is in breach of terms and conditions.

                  4. We reserve the right to withdraw or cancel vouchers at any point.

                3. Gift Cards 

                  1. Valid gift cards can be used to purchase all products in Majestic UK stores, but cannot be used for glass loan deposits. 

                  2. Gift cards are valid for two years from the date of issue. Unused gift cards after this time cannot be used or refunded.

                  3. Gift cards cannot be redeemed or exchanged for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender.

                  4. If your purchase exceeds the value of the gift card, balance must be paid by cash, debit or credit card.

                  5. If your purchase value is less than the face value of the gift card redeemed, no change can be given.

                  6. If you return any products you have purchased using a gift card, the refund balance will be returned to you in the form of a gift card.

                  7. Gift cards cannot be replaced if lost or stolen.

                  8. Majestic reserves the right to cancel a gift card if we deem necessary. If so, we will provide a replacement gift card of equivalent value unless we suspect fraud in relation to the original gift card.

                  9. Majestic reserves the right to vary or replace these conditions at any time.

                4. Promotional offers, subscriptions and memberships

                  1. We may from time to time run promotions or special offers on our products and/or various subscriptions or memberships for our products. Where you order products which are included in a promotion or special offer or become a member or subscribe to a service, there are additional terms and conditions which apply to those promotions, special offers, subscriptions and memberships which can be found here. We reserve the right to withdraw these promotions, special offers, subscriptions and memberships at any point.

                5. Majestic in Scotland

                  1. Our prices in Scotland work differently than England and Wales

                  2. The Alcohol Scotland Act 2010 disallows any alcohol promotion offering customers a discount for buying multiple products in Scottish stores whilst the Alcohol (Minimum Pricing) (Scotland) Act 2012 sets a minimum price per unit for all alcoholic beverages sold in Scotland.

                  3. So that all our customers can benefit from the same competitive pricing, wherever a Mix Any Six & Save price is offered in England and Wales, this will be the single bottle price we charge in Scotland, unless such a price is beneath the minimum price threshold as outlined by the Alcohol (Minimum Pricing) (Scotland) Act 2012, in such cases the price will automatically be changed to reflect the minimum legal price in Scotland.

                6. Online pricing

                  1. Our website allows you to indicate where you would like delivery or collection before ordering. By default, our website shows the pricing in England and Wales. If you select an address served by a store in Scotland, however, the prices shown online change to reflect the single bottle prices effective in Scotland as per the Alcohol (Minimum Pricing) (Scotland) Act 2012.

                  2. In the vast majority of cases, the total for your order will be exactly the same as an order placed in England or Wales however prices may vary due to differences in the way the prices are rounded when English multi-buy discounts are calculated.

                  3. Since Scottish Licensing Legislation only covers deliveries that originate in Scotland, some deliveries to Scottish addresses are not affected because they originate in England. In these cases the prices shown online will be the prices valid in England and Wales including Mix Any Six & Save discounts. This is also the case if you are based in Scotland but are placing an order for delivery to an address in England or Wales.

                  2. Any changes to email contact preferences usually take between 2-7 days to take effect, but in some instances may take as long as 28 days to take effect.

    Special conditions relating to "Sale or Return Policy"


    1. These terms and conditions set out the terms on which you can return wine, beer and cider (collectively “Beverages”) purchased for occasions and special events and receive a refund.
      You will be entitled to return up to 25% of the price [at the point of purchase /point of return ] of unused Beverages, provided that:
      a. you return the cases or bottles of the Beverages, unused and unopened, in the same condition and state in which you received the Beverages;
      b. you have ordered the Beverages for an event or occasion;
      c. the Beverages have been stored appropriately in line with any guidance provided by us or the producer;
      and
      d. the unused Beverages are not damaged or defective in any way whatsoever.
    2. You must return the Beverages within 21 days of the event or occasion. Note that this does not affect your legal rights. Please see section 12 of our Consumer Terms & Conditions for more information on returns.
    3. Provided you satisfy the requirements under these terms and conditions for a refund, the amount outlined in section 2 will be refunded to you via the same method of payment in which you ordered the Beverages.
    4. Your legal rights are not affected and you still have a right to return the products in accordance with Section 12 of our Consumer Terms & Conditions*. However, if you handle the goods whilst they are in your possession in a way which would not be permitted in store (for example, by opening a bottle or removing a seal), we will reduce your refund to reflect the reduction in the value of the goods.
    5. You accept full responsibility for the security, safety, and risk of any Beverages you wish to return pursuant to these terms and conditions.
    6. Only one entry will be accepted per person. Multiple entries from the same person will be counted as one entry.
    7. These terms and conditions are subject to and governed by our Consumer Terms & Conditions. By returning any orders in accordance with our sale or return policy, you agree to bound by these terms and conditions, together with our Consumer Terms & Conditions.

    Special conditions relating to "Wine Club Subscriptions"

    1. Persons must be aged 18 and over to subscribe. By subscribing, you are confirming that you are 18 or older. It is illegal for us to sell alcohol to anyone under the age of 18.
    2. You can sign up to ‘Wine Club’ either in-store or online. Signing up and subscribing to ‘Wine Club’ means we will automatically send you your chosen Case(s) at a quarterly frequency, subject to availability.
    3. By subscribing to ‘Wine Club’ you are agreeing to pay recurring periodic subscriptions for an indefinite time, until deactivated by you or us, on the subscription terms set out in these terms.
    4. Wine Club by Majestic is not subject to our price match guarantee.
    5. To sign up for this service, you must create an online account.
    6. You can cancel your membership at any time. You will not be charged for cancellation and you can re-subscribe at any time following your cancellation, but we reserve the right not to permit re-subscription where we have previously terminated your subscription.
    7. Delivery is free anywhere in mainland UK. Delivery restrictions apply. You can find these here. ID will be required on delivery in line with licensing laws.
    8. We will email you before each case is due, and you can skip or make changes by the cut-off date in ‘your case is ready’ email if the order or the timing of the order is not right.
    9. Payment will be debited from your registered default credit/debit card held within the “My Account” tab. Our ‘Wine Club’ subscription charges can be found here. By supplying or registering your credit or debit card details with us you are confirming that you agree for your credit/debit card to be charged the subscription charges on a quarterly basis via your chosen payment method, that you are either the card holder, or that you have permission from the card holder to use the card for the purpose of ordering products from us.
    10. We will take payment from your card as soon as your order is despatched.
    11. We will attempt to auto-update your card details if we cannot take your payment. After 3 failed attempts, your subscription will move to your next due date. We may get in touch to request new card details if payment fails after multiple attempts.
    12. We cannot guarantee the availability of a specific product and case of wine and reserve the right to substitute with a similar product should a product be unavailable. You will of course be notified. Our ‘No Quibble’ Guarantee will apply to your subscription. For more details, please click here.
    13. We reserve the right to cancel any orders we cannot fulfil for any reason. If your order is cancelled, we will contact you to explain why and refund you any payment you have paid us for that order.
    14. Changes to your Case choice, quantity, or payment details can be made online anytime. Alternatively, please call our dedicated Wine Club team on 0330 818 0750.
    15. We will provide a full refund or replacement for any damaged or faulty wines provided such damage or fault is not caused by you. This does not affect your legal rights.
    16. Customers purchasing products for business or commercial use or for resale purposes are not permitted to use this service. Any customer found to be doing so will have their membership cancelled.
    17. ‘Wine Club’ cases cannot be purchased using vouchers and do not qualify for any additional discounts or promotions.
    18. “Wine Club Benefits” - Special conditions relating to "Wine Club Benefits”
      To qualify for "Wine Club Benefits", you must be an active member. An active member is defined as having a live account and having taken equal to or more than 50% of case sends within the last year.
      For example: -Cancelling your subscription will result in the deactivation of your benefits. -Skipping over 50% of previous sends will deactivate your benefits.
      1. Benefit - "Wine Club New Sign-Up Subscription Vouchers" - Sign-up vouchers are issued to new customers, and are issued for the first year of subscription, only. Vouchers are valid provided that you are deemed to be an active member as defined above.
        1. Sign-up vouchers issued pre-April 2023 come in a physical booklet – Each voucher in this book will cover two months of a calendar year and will become valid at midnight on the first day of the first stipulated month and expire at 23:59:59 on the last day of the voucher’s second stipulated month. Please see each individual voucher for the months in which the voucher is valid and redeemable.
        2. Sign-up Vouchers issued April 2023 onwards will be sent digitally via email – Your first voucher will be sent in the month following your signup to your account email address. Provided that you are an active member, vouchers will be sent out on a monthly basis for a period of ten months (excluding November and December). Qualifying spend is based on still wine only and excludes delivery fees. Still wines are red, white and rosé wines, excluding Champagne, sparkling, fortified and dessert wines. Offer excludes beer, soft drinks, spirits and snacks.

      3. Benefit - 10% off at Showcase Tastings for Wine Club Members - Wine Club members receive an extra 10% off any purchase made at the end of the Showcase Tastings event. Ask our in-store colleagues to find out more. To benefit from this, please show your last case-ready email. Such events will be subject to separate terms.
      4. Benefit - Two free tickets to a Discovery Tastings event for Wine Club Members - Members will receive two free tickets to our exclusive, expert-led Discovery Event tastings. Tickets will be emailed to you annually in the month of your Wine Club sign-up anniversary. Tickets will be valid for one year from the date of issue and our event tastings will be subject to separate terms.
    19. We reserve the right at our discretion not to renew your subscription at any time without giving any reasons for our decision. Such reasons may include (but not limited to) suspicion of fraud.
    20. You can cancel your Wine Club subscription at any time, by:
      1. logging in to your Majestic account and following the cancellation procedure,
      2. sending us a message at wineclub@majestic.co.uk, or
      3. contacting our dedicated Wine Club team on 0330 818 0750 and we will help you cancel your subscription.
    21. Prices may be subject to change, but we will always update you before your next case is sent so you have time to make changes if required.
    22. We reserve the right to amend these terms if necessary, including but not limited to if there is a change in any applicable law, changes in the cost of us providing our services, or any other reason that makes such change necessary.

    Entry

    Winner selection

The selected winner will be contacted to notify them that they have won and will be required to confirm their acceptance of the Prize within 30 days. If the selected winner fails to respond within 30 days, then the winner’s Prize will be forfeited, and Majestic will be entitled to select another winner in accordance with the process described above.

    Prize delivery
    1. Majestic will arrange and shall be responsible for the shipping and delivery of the Prize (less the original case which will have already been delivered and as described below) to the postal address recorded in the winner’s customer account with Majestic or an alternative address provided by the winner once contacted by Majestic. Delivery charges shall not be applicable or payable by the winner.

    Winner’s details
    1. Majestic must either publish or make available information that indicates that a valid award took place.     Special conditions relating to "En Primeur"



    Technical Terms:

    En Primeur; literally means “wine futures”. The method of purchasing wine before bottling via a dedicated merchant or winery.
    In bond; buying in bond is a way of purchasing wine before Duty and VAT have been paid. They must be stored in a bonded warehouse approved by HM Customs & Excise.
    X “Growth” refers to a classification laid out in the Bordeaux Classification of 1855, when brokers organised wineries based on quality, price and reputation - from first to fifth. The system is largely still used to this day.

    Majestic En Primeur Conditions:

    Pricing:
    Prices are specific to each vintage and are quoted in bond, inclusive of freight and delivery to our Cellar partner. Prices shown does not include excise duty or VAT. Payment of duty and VAT, at the prevailing rate (currently £26.78 duty per 12 75cl case, £13.39 per 6 bottle case and 20% VAT payable on wine and duty) will be requested once the wines are removed for delivery. Prices may vary due to fluctuations in currency and the market and to stock not being sold.

    Storage
    Once released from the winery, wines will be stored in-bond by Majestic’s cellaring partner. We will notify you via email when this occurs. At this point you will be liable to be charged Majestic’s cellaring cost, which is currently £7 per six months per 4.5l. This is the minimum cost therefore the same annual cellaring cost of £14 will be applicable to quantities of less than 6 bottles
    Example - For a total order of 4 x cases of 6 bottles, the total annual cellaring cost would be £56. Payment requests will be sent via email within 30 days of the wine arriving at our cellaring partner. The cellaring cost will commence at the point of receipt. If wine is removed before the full 12 months,  the total annual cellaring cost will still be payable.


    Delivery:
    Shipping to our storage facility will be confirmed at a later date, which is expected to be around the time of summer 2025. We will update all customers on pricing and timescales in due course.

    Insurance & Ownership:
    Majestic remains responsible for insuring the wine at the original price paid until your delivery and/or storage instructions have been completed. If for whatever reason we are unable to provide the full allocation of wines originally ordered (due to damage or situations beyond our control) we will refund the customer’s initial payment in full. We also offer a wine condition service, the pricing of which is available upon application.

    Orders:
    Orders are placed under Majestic’s En Primeur conditions. Stocks of certain wines may need to be allocated subject to demand, on a first come first served basis. Some customers may not therefore be allocated any or only some of the quantities they have ordered. Orders will only be accepted if there remains unsold stock.

    Buying for Investment:
    Majestic does not advise on buying for investment, and customers should be aware that price may vary due to fluctuations in currency and the market and to stock not being sold.

    Refunds and Returns: Due to the nature of En Primeur, Majestic will not accept any refunds or returns once the wine has been shipped. Likewise En Primeur wines are not covered by Majestic’s No Quibble policy.

    Special conditions relating to "Gift Cards and E-Gift Cards"


    Valid gift cards can be used to purchase all products in Majestic UK stores, but cannot be used for glass loan deposits.

    Gift cards are valid for two years from the date of issue. Unused gift cards after this time cannot be used or refunded.

    Gift cards cannot be redeemed or exchanged for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender.

    If your purchase exceeds the value of the gift card, balance must be paid by cash, debit or credit card.

    If your purchase value is less than the face value of the gift card redeemed, no change can be given.

    If you return any products you have purchased using a gift card, the refund balance will be returned to you in the form of a gift card.

    Gift cards cannot be replaced if lost or stolen.

    Majestic reserves the right to cancel a gift card if we deem necessary. If so, we will provide a replacement gift card of equivalent value unless we suspect fraud in relation to the original gift card.
